Welcome to HealthSafe, a visitor and health and safety management software-as-a-solution service, owned and operated by HealthSafe NZ Limited, a company registered in New Zealand, with its registered office at 697C Wairere Drive, Hamilton, New Zealand (“HealthSafe”, “we”, “us” or “our”).

These terms of use (Terms of Use) set out the rights and obligations between the person or organisation that accesses the HealthSafe website at healthsafe.co (Website). In these Terms of Use, any person who accesses or uses the Website is referred to as “you” or “your”. Please read these Terms of Use together with our Privacy Policy located at https://healthsafe.co/privacy-policy.

By using or accessing the Website, you agree to follow and be bound by these Terms of Use. We may change these Terms of Use at any time, effective when we post the updated terms on the Website. By continuing to use the Website, you agree to be bound by the updated Terms of Use. If you do not accept the updated Terms of Use, you must stop using the Website.


1.       Your use of the Website

1.1      You will comply with all applicable laws when using the Website.

1.2     You will not, and will not attempt to (or assist others to):

(b)      use a harvesting bot, robot, scraper, or other unauthorised automated means to access the Website or obtain its content for any purpose;

(e)      do anything that could disable, overburden, or impair the proper working of the Website, such as a denial of service attack; or

1.3     You do not need an account to access and browse the Website, but you will need to agree to separate terms and conditions to receive services from us. 

1.4     If you provide us with personal information, then our Privacy Policy (located at https://healthsafe.co/privacy-policy) applies.

2.      Intellectual Property

2.1     The Website, including all of its content, all software code underlying and forming part of the Website, and any improvements, enhancements, or modifications to the Website are our exclusive property, or are used and displayed by us with the express permission of the owner.

2.2    You may view, save or print any part of the Website for your personal or internal business use only. Any other use of the Website and its content requires our prior written permission, which may be subject to additional conditions.

2.3    You must not use our branding, logos or trade marks for any purpose without our prior written permission, which may be subject to additional conditions.

2.4    If you wish to use any third party material that is included on the Website then you must obtain the prior consent of the relevant owner. This includes the content of websites you access via links from the Website. 

2.5    We appreciate your feedback on how to improve the Website. By providing us with feedback, you agree that we are free to use your feedback without any payment or compensation to you, and you will not have rights to any intellectual property that may be generated as a result.

3.1     The Website may include links to third party websites or applications. Those links are provided for your convenience only and we take no responsibility for those third party websites or applications and make no representations regarding the accuracy or quality of the content, information, products, or services they display. 4.      Our responsibilities and liability

4.1     Except as expressly stated in these Terms of Use:

(a)      we exclude all warranties, conditions, and terms in relation to the Website, whether express or implied by statute, common law or otherwise, to the maximum extent permitted by law;

(b)      we do not make any promises about the availability, accuracy, completeness, currency or reliability of the Website or any content on the Website;

(c)      we do not promise that the Website will operate on all types of devices or be uninterrupted, secure or error–free; and

(d)      we may update and change the Website from time to time without notice without any liability to you.

4.2    To the maximum extent permitted by law, if we breach these Terms of Use or our obligations to you, we are only responsible to you for the loss, damage or expense that you suffer that is a direct and foreseeable result of that breach.

4.3    To the extent that that our liability cannot be excluded but can be limited by law, our total liability to you under or in connection with these Terms of Use will be limited to a sum not exceeding NZ$20.

4.4    You will indemnify us for any loss, damage or expense we reasonably incur in relation to any third party claim against us resulting from or in connection with:

(a)      your use of the Website, except to the extent the loss or damage is caused by our negligence or breach of these Terms of Use; and

(b)      your breach of these Terms of Use.

5.      General

5.1     These Terms of Use, our Privacy Policy and any further terms that may be referenced on the Website to be between you and us are the entire legal agreement between you and us governing your use of the Website, and completely replace any prior agreements between you and us in relation to the Website.

5.2    These Terms of Use are governed by the laws of New Zealand and you submit to the exclusive jurisdiction of the New Zealand courts for any dispute (including non-contractual disputes) that arises in relation to or in connection with the Website.

5.3    If any part of these Terms of Use is deemed to be illegal, invalid or unenforceable it will be limited or excluded to the minimum extent possible, and the remaining terms will continue to operate in full force and effect.

5.4    Any waiver of a right in these Terms of Use must be in writing.

5.5    The headings used throughout these Terms of Use are provided for your convenience and do not affect the meaning of these Terms of Use.
